Advertisement Terms And Conditions
In these terms and conditions "The Service Provider" shall mean ApartmentsDirect.ie. "The Advertiser" shall mean the person / company who orders The Service. "The Service" shall mean a property advertisement on www.apartmentsdirect.ie only. "The Property" shall mean the property contained within the property advertisement web page on www.apartmentsdirect.ie. "The Consumer" shall mean the person/company who agrees to rent or buy The Property.
(1) THIS CONTRACT
This Contract shall run for a period of 12 months (unless otherwise stated) from the date The Advertisers advert goes Live on The Service Providers web site www.apartmentsdirect.ie. The Advertiser acknowledges and accepts that once they have ordered The Service or any optional extras attached to The Service,they shall be liable to The Service Provider for the full cost of The Service. The Service Provider makes no guarantee whatsoever that The Advertiser will receive any enquires, bookings or sales from their property advert(s).
(2) LEGAL OWNERSHIP OF THE PROPERTY & PROPERTY INFORMATION
(a) The Advertiser confirms they are the legal owner all the property information they display on their property advertisement web page, or they have the relevant authorisation from the legal owner of the property information to display the said property information in their advertisement and hereby gives The Service Provide permission, without charge, to use the said property information and/or photos in any promotional advertisement campaign The Service Provider may undertake to promote The Service Provider's web site. The Advertiser also accepts complete liability for all information they display on their advertisement web page and agrees to indemnify The Service Provider against any claims and costs, whatsoever, in relation to the said information.
(b) The Advertiser agrees to display honest, complete, and accurate information in respect of The Property on their advertisement web page and also agrees to provide a friendly and polite service to The Consumer and not to supply, verbally or otherwise, misleading, dishonest, or incomplete information in respect of The Property or surrounding area to The Consumer.
(3) THE SERVICE PROVIDERS LIMITATIONS OF LIABILITY
The Advertiser acknowledges and accepts that The Service Provider is only providing them with an advertisement service in the form of an advertisement web page hosted on The Service Provider's web site, www.apartmentsdirect.ie. The Advertiser further acknowledges and accepts that The Service Provider does not guarantee that The Service Provider's web site will operate smoothly and without any errors or interruptions and that in the event there are errors and/or interruptions to the smooth operation of The Service Provider's web site, The Advertiser agrees not to hold The Service Provider liable for any claims, loss, or costs, whatsoever, as a result of the said errors and/or interruptions and that they shall only be entitled to one free days advertisement in lieu of each day the said errors and/or interruptions prevented the smooth operation of The Advertiser's web page.
(4) YOUR PROPERTY ADVERTISEMENT WEB PAGE
(a) Your standard property advertisement web page will contain various information fields to enter information and descriptions of The Property, four photographs (additional photos at extra charge), your personal contact details, your payment and cancellation policies, your booking terms & conditions, an availability calendar, your own photo uploader, and an on-line booking enquiry form.
(b) The Advertiser acknowledges and accepts it is their responsibility to enter all information for their advertisement web page and to update and maintain their own property web page(s).
(c) The Advertiser acknowledges and accepts that The Service Provider reserves the right to edit or change the content of their property listing or remove any text The Service Provider deems unacceptable, this includes, but not limited to, any reference whatsoever to a competitor.
(5) EMAIL & WEB SITE ADDRESSES & CLICKABLE LINK FACILITY
The Advertiser acknowledges and accepts that The Service Provider does not allow any email or web site address to appear on their advertisement web page. The Advertiser accepts that The Service Provider reserves the right to either charge them for displaying an unauthorised web site address on their advert and/or remove their advert without refund, compensation or otherwise to The Advertiser, if The Advertiser displays an unauthorised email address and/or a web site address on their advert. If at the end of the advertisement period it is found that The Advertiser has displayed an unauthorised web site address on their advert, The Advertiser hereby agrees to pay The Service Provider the full cost of the Clickable Link facility at the full rate and gives The Service Provider authorisation to debit their credit card for this fee. There is no need to display an email address on your advert as all on-line enquires are instantly delivered directly to the email address attached to your advertisers account or to the email address listed in the Contact Details section of your advert. If The Advertiser wishes to display their web site address on their advertisement web page, they must buy the Clickable Link facility which is a optional extra facility and is sold at two different options. The first option is at a reduced rate in return for The Advertiser placing a link on their web sites homepage or at the top of the first page of their links pages, to The Service Provider's web site. The link shall be as follows;

The second option is charged at full price but does not require The Advertiser to place a link on their web site to The Service Provider's web site. If The Advertiser purchases the clickable link facility at the reduced rate option, then they agree to place a link on their web site's homepage or at the top of the first page of their links page, to The Service Provider's web site for the duration the reduce rate clickable link remains on their advert with The Service Provider. If The Advertiser refuses or fails to display the above link code on their web site in the correct place or at all, The Service Provider shall be entitled to remove The Advertiser's advert from their web site without refund until such a time the said link is put in place. The Advertisers clickable link code shall be placed at the bottom of their adverts main property description area. The Advertiser agrees not to alter the code in any way whatsoever and not to copy or move the clickable link code to any other part of their advert. If The Advertisers does alter the link code in any way, copies or moves the link code in any way The Service Provider shall be entitled to remove The Advertiser's advert from their web site without notice and without refund. The Service Provider reserves the right to refuse to accept any URL The Advertiser wishes to link to from their advert.
(6) TERMINATION OF THIS CONTRACT
(a) The Advertiser may cancel this contract and remove their advertisement from The Service Provider's web site at any time, however, they shall not be entitled to a replacement advertisement or a refund of any money paid in respect of their advertisement whether they removed their advertisement accidentally or otherwise. If The Advertiser deletes their advertisement accidentally or otherwise, they accept that they do so at their own expense and that they shall not be entitled to a replacement advertisement or a refund of any money paid in respect of the deleted advertisement and if The Advertiser creates a new advertisement, it shall be treated as a totally new advertisement and not as a replacement advertisement for their deleted advertisement.
(b) The Service Provider reserves the right to terminate this contract and remove The Advertiser's advert from their web site without notice if, in The Service Provider's opinion, the content of The Advertiser's advert may bring the good name and integrity of The Service Providers web site and/or service into disrepute.
(c) The Service Provider reserves the right to terminate this contract and remove The Advertiser's advert from their web site without notice if there are persistent complaints in respect of The Advertiser's property and/or level of service The Advertiser provides to The Consumer(s).
(d) The Service Provider reserves the right to terminate this contract and remove The Advertiser's advert from their web site without notice if The Advertiser sends any correspondence, via email or otherwise, to The Service Provider, or displays on their web page, any content that may be harmful, hateful, threatening, abusive, unlawful, harassing, defamatory, vulgar, obscene, pornographic, libellous, or of a racial nature.
(e) The Service Provider reserves the right to terminate this contract and remove The Advertiser's advert from their web site without notice if The Advertiser refuses or fails to pay the relevant advertising fee by the due date as indicated by The Service Provider. If in this event The Service Provider cancels this contract The Advertiser shall still remain liable to The Service Provider for the full cost of their advertisement and all The Service Provider's recovery costs.
(f) The Service Provider reserves the right to terminate this contract and remove The Advertiser's advert from their web site without notice if The Advertiser breaches any of the Terms and Conditions of this contract.
(g) The Advertiser acknowledges and accepts that they shall not be entitled to a refund of their money or to make a claim for compensation if this contract is cancelled by The Service Provide for breach of this contract.
(h) The Service Provider reserves the right to terminate this contract and remove The Advertiser's advert from their web site without notice if The Advertiser uses any form of HTML coding or similar coding on any part of the advertisement web page.
(7) PAYING FOR YOUR ADVERTISEMENT
You can pay for your advertisement by credit card using a Visa, MasterCard, or Laser Card. Please note you still remain liable for the full cost of your advertisement even if your credit card is not authorised for payment. You may also pay by cheque or bank draft provided your cheque or bank draft is drawn on an Irish bank. You can also pay by bank transfer provided there are no bank charges at all levied against us. Contact us for our bank details if required. You may also pay by Euro cash provided you send it to us by registered post only.
(8) RENEWING YOUR ADVERT
The Advertiser agrees and accepts that when renewing their advert the rate given online is for a standard listing and does not include the cost of any of the optional extras we offer such as, additional photos, special offer and late deals facilities, extra page facility and clickable link facility. Payment for these optional extras will be deducted from your credit card in addition to the standard advert cost.
(9) INCLUSION IN OUR MAILING LIST
The Advertiser accepts and agrees that if they register an advertisers account on The Service Providers web site www.apartmentsdirect.ie, they give their permission to The Service Provider to email them in relation to promotional offers and general issues related to their advertiser’s account, whether or not they have a Live listing. The Service Provider will provide in these promotional emails a facility to enable The Advertiser to unsubscribe their email address. The Advertiser accepts that they can contact The Service Provider to have their email address manually removed from the Service Provider’s mailing list however The Advertiser accepts that The Service Provider cannot and does not guarantee they will receive such requests and that it is The Advertiser's responsibility to use the automated unsubscribe facility provided to them by The Service Provider in the marketing emails they receive.
(10) JURISDICTION
This contract shall be governed by and subject to the laws and courts of the Republic of Ireland.
