In these banner advertisement terms and conditions "The Service Provider" shall mean ApartmentsDirect.ie. "The Advertiser" shall mean the person / company who orders The Service. "The Service" shall mean a banner advertisement placement on www.apartmentsdirect.ie.

(1): THIS CONTRACT
This Contract shall run for the banner advertisement period purchased by The Advertiser and shall start from the time The Advertiser’s banner appears live on The Service Providers web site.


(2): THE SERVICE PROVIDERS LIMITATIONS OF LIABILITY
The Advertiser acknowledges and accepts that The Service Provider is only providing them with a banner advertisement service hosted on The Service Provider's web site, www.apartmentsdirect.ie. The Advertiser further acknowledges and accepts that The Service Provider does not guarantee that The Service Provider's web site will operate smoothly and without any errors or interruptions and that in the event there are errors and/or interruptions to the smooth operation of The Service Provider's web site, The Advertiser agrees not to hold The Service Provider liable for any claims, loss, or costs, whatsoever, as a result of the said errors and/or interruptions and that they shall only be entitled to one free days advertisement in lieu of each full day the said errors and/or interruptions prevented the smooth operation of The Service Provider’s web site.

In these terms and conditions "The Service Provider" shall mean ApartmentsDirect.ie. "The Advertiser" shall mean the person / company who orders The Service. "The Service" shall mean a banner advertisement placement on www.apartmentsdirect.ie.

(3): YOUR BANNER ADVERTISEMENT
The Advertiser acknowledges and accepts the following;
Option 1 Banners: Your option 1 banner will appear at the top of property search results only for the particular continent, country or an individual region you purchase. Example, if you purchase country Spain and no other location, your banner will appear at the top of property search results for Spain. It will not appear on search results for any region within Spain unless you also buy these regions.

Option 2 Banners: Your option 2 banner will appear at the top of all pages within the public areas of our site www.apartmentsdirect.ie apart from property and service providers search results pages. These banners are rotating banners with a maximum of six banners in the rotation cycle. Option 2 banners are displayed on a random basis and each banner will display for ten seconds before displaying the next banner in the rotation cycle.

Option 3 Banners: Your option 3 banner will appear at the top of all pages inside every one of our registered advertisers account holders.
You accept that once you have ordered and confirmed your banner advertisement to us, you will not be able to change or substitute your banner at a later date until your current banner advertisement period has expired.
Your accept that The Service Provider does not provide or offer any guarantees whatsoever regarding the number of impressions or click-throughs your banner may or may not achieve. Your further accept and acknowledge that you are paying a fixed rate banner advertisement cost to have your banner displayed on The Service Providers web site www.apartmentsdirect.ie for the period of time you purchase and which is not based on your banner advert achieving a certain number of impressions or click-thrus.

You acknowledge and accept that you must provide your own banner to us as per the required dimensions for the particular banner space you are purchasing.

You acknowledge and accept that The Service Provider reserves the right to refuse to accept your banner advertisement order if in the opinion of The Service Provider your banner and/or site your banner links to is not suitable to be carried on The Service Providers site.


(4): TERMINATION OF THIS CONTRACT
- (a) The Advertiser may cancel this contract and remove their banner advertisement from The Service Provider's web site at any time, however, they shall not be entitled to a refund of any money paid in respect of their banner advertisement.
- (b) The Service Provider reserves the right to terminate this contract and remove The Advertiser's banner advert from their web site without notice if there are complaints in respect of The Advertiser and or the service The Advertiser provides to members of the public.
- (c) The Service Provider reserves the right to terminate this contract and remove The Advertiser's banner from their web site without notice if The Advertiser displays on their web site or sends The Service Provider any content that is abusive, harmful, hateful, threatening, abusive, unlawful, harassing, defamatory, vulgar, obscene, pornographic, libellous, or of a racial nature.
- (d) The Service Provider reserves the right to terminate this contract and remove The Advertiser's banner from their web site without notice if The Advertiser refuses or fails to pay the relevant advertising fee by the due date as indicated by The Service Provider. If in this event The Service Provider cancels this contract The Advertiser shall still remain liable to The Service Provider for the full cost of their advertisement.
- (e) The Service Provider reserves the right to terminate this contract and remove The Advertiser's banner from their web site without notice if The Advertiser breaches any of the Terms and Conditions of this contract.
- (f) The Advertiser acknowledges and accepts that they shall not be entitled to a refund of their money or to make a claim for compensation if this contract is cancelled by The Service Provide for breach of any of terms and conditions contained in this contract by the Advertiser.


(5): PAYING FOR YOUR BANNER ADVERTISEMENT
Payment for your banner advertisement is due in advance of your banner appearing live on The Service Providers web site. You can pay for your advertisement securely online from inside your advertisers account using a valid credit or debit card using. Please note you still remain liable for the full cost of your banner advertisement order even if your credit or debit card is not authorised for payment.


(6): JURISDICTION
This contract shall be governed by and subject to the laws and courts of the Republic of Ireland.
